Ethics & AI commitment
We build agents that help, not deceive. Concretely:
Disclosure
Every agent identifies itself as an AI the first time a customer asks, and whenever the conversation turns to a regulated topic (payments, health, legal). No dark patterns, no fake pauses to simulate a human.
Data minimization
We only send to Claude what the agent needs to answer: the current message plus a bounded context window. We do not sell data. We do not train third-party models on your conversations.
Human escalation
Sensitive domains — billing disputes, cancellations, complaints, anything flagged — escalate to a human with the full transcript attached. The customer never has to repeat themselves.
Refusal
We refuse engagements where agents would be used to mislead, manipulate, or impersonate a real person without consent. If you're unsure whether your use case fits, write to ethics@presencia.lat.

International transfers
By default, data is stored in the EU (Frankfurt). Claude model calls go to Anthropic infrastructure; see their privacy policy. All transfers outside the EEA are covered by Standard Contractual Clauses (2021/914).
Your rights
Under GDPR you have rights to access, rectify, erase, restrict, object, port your data, and withdraw consent. See DSAR to exercise them. You can also complain to your supervisory authority (in Spain: AEPD).
Terms of service
These terms govern use of the Speed to Lead platform. By signing up you agree to them.
1. The service
Speed to Lead provides AI agents deployable on the official WhatsApp Business API. We are not a carrier or telecom; message delivery is subject to Meta's WhatsApp Business policies.
2. Your responsibilities
- You own the content your agents send, and you are responsible for its legality.
- You will not use the service for spam, harassment, misleading claims, or regulated activities without proper licensing.
- You will obtain consent from your end-customers before initiating WhatsApp conversations, as required by Meta's policies and applicable law.
3. Fees & billing
Plans are billed monthly in advance. Overages (conversations above plan limits) are billed at end of cycle. Prices exclude VAT. Refunds are prorated for unused days in the event of a service-level breach.
4. Uptime
We target 99.9% monthly uptime for the API and dashboard. Scale plans include an SLA with service credits.
5. Termination
You can cancel anytime from the dashboard. We may suspend accounts that breach these terms or Meta's WhatsApp Business policies, with 7 days' notice except in cases of imminent harm.
6. Liability
To the extent permitted by law, our aggregate liability is capped at the fees paid in the prior 12 months. We are not liable for indirect, incidental, or consequential damages.
7. Governing law
These terms are governed by Spanish law. Disputes go to the courts of Madrid, without prejudice to mandatory consumer rights.
Data Processing Agreement (DPA)
When you use Speed to Lead to process personal data of your end-customers, this DPA applies and forms part of your contract.

You are the controller. Speed to Lead S.L. is the processor. The DPA incorporates the EU Commission's Standard Contractual Clauses (controller-to-processor, Module 2).
